Twitao Image Recognition Member Service Agreement

[Important Notice]

Please carefully read, understand, and comply with the "Image Recognition Member Service Agreement" (hereinafter referred to as "this Agreement") in order to use the Image Recognition Member Service. This agreement is jointly entered into by you and AL KUWAITYA CO., LIMITED (hereinafter referred to as "Twitao" or "Twitao Company") and has contractual effect. The clauses in the agreement that have a significant interest in your rights, including but not limited to clauses related to exemption or limitation of liability, clauses restricting user rights, provisions on dispute resolution and jurisdiction, etc., may be highlighted in bold, colored or other reasonable ways to remind you to pay attention and please read them carefully.

If you do not agree with any or all of the terms of this agreement, please do not activate or use this service. If you choose this service, you may proceed with the next steps or use this service by accepting this service (including but not limited to clicking agree, activate or renew, or conducting transactions related to paid membership services, accepting gifts, participating in activities, or using any other form of confirmation, collectively referred to as "accepting service"), to indicate that you have read, understood, and agreed to sign this agreement, And voluntarily accept and abide by all provisions of this agreement.

1、Definition and Explanation of Protocol

1.1 [Twitao Image Recognition Members and Accounts]

If you need to use and enjoy the Twitao image recognition paid membership service, you need to authorize and log in to the Twitao account that you have the right to use. After logging in, you can open different types of paid membership services. After successfully opening the membership, your account becomes a Twitao member account within the validity period of the membership, and you can enjoy the corresponding membership benefits during the validity period of the membership. You are a paid member of Twitao Image Recognition during the validity period of your membership, also referred to as "you", "user" or "member" under this agreement.

1.2 Membership rules refer to the user guidelines, activity rules, usage rules, announcements, reminders, notifications, and online FAQs related to Twitao image recognition paid member users that Twitao service providers may publish and revise from time to time.

1.3 Service Provider refers to AL KUWAITYA CO., LIMITED, which provides Twitao and its services to you, referred to as "Twitao Company" in this agreement.

1.4 Membership data refers to various data generated by the server during your use of Twitao, including but not limited to login records, browsing records, listening records, download cache records, upload file (including but not limited to files, music, videos, etc.) records, virtual item data, operation behavior logs, purchase logs, recharge records, messages, comments, membership level, membership period, membership assets, and other data.

1.5 Protocol modification. Twitao Company has the right to modify this agreement (including its constituent parts) (including changes, additions, and deletions of corresponding clauses). Once this agreement is modified, Twitao will prompt or publicize it on the relevant page. Please read it carefully. If you do not agree to the modification of this agreement, you may stop using this service. If you choose to continue using this service, you may proceed to the next step by accepting the service or continue using this service to indicate that you have accepted all modifications to this agreement. If you have any questions, you can consult Twitao customer service in accordance with Article 8 of this agreement. The updated version of this agreement shall come into effect from the date of its release.

2、 Account management and usage

2.1 Due to the necessity of providing services to you, you need to fill in some necessary information during the process of applying to activate the paid membership service for image recognition. Please maintain the authenticity of this information and update it in a timely manner so that Twitao can provide you with assistance or better serve you. If your information is incomplete or inaccurate, you may not be able to use the service or may be restricted during use.

2.2 Twitao Company reminds you to keep your account and password safe. After using it, you should safely exit. Due to your poor storage, you may suffer from account theft, password theft, or the use of virtual property. You are solely responsible for this.

2.3 Twitao Company is committed to protecting personal information with users, and protecting user personal information is a fundamental principle of the company. Without your consent, Twitao Company will not disclose your personal information to any company, organization, or individual outside of Twitao Company, except as otherwise provided by laws, regulations, and this agreement.

2.4 If any of the following situations occur, the company has the right to disclose or process the user's information:

(1) Disclosed with the consent of the user;

(2) Necessary for the conclusion and performance of this agreement;

(3) Necessary for responding to sudden social events or in emergency situations to protect the life, health, and property safety of natural persons;

(4) Implementing news reporting, public opinion supervision, and other behaviors for the public interest, and processing personal information within a reasonable range;

(5) Processing personal information that is publicly available or other legally available within a reasonable range

(6) Disclose to others or administrative or judicial institutions in accordance with relevant legal provisions or requirements;

(7) Other Twitao companies consider it appropriate to disclose for user service purposes;

(8) Other circumstances that Twitao Company may disclose in accordance with the law or agreement.

2.5 You understand and agree that in order to better provide services to users, Twitao Company may:

(1) The use of the information you submitted may result in inaccuracies. Please exercise caution and make independent judgments when using related services;

(2) Use your nickname, profile picture, and related operation information in paid membership services, and display them to yourself and other users through Twitao services or third-party services provided by Twitao services.

3、Acquisition and Termination of Paid Membership Services

3.1 You should obtain paid membership services through Twitao's existing and future official designated channels. When you use a specific method to activate paid membership services, you must carefully check your account, service type, duration, price, membership benefits and other specific information, and confirm your agreement to the relevant agreements and usage methods. After the activation is completed, no transfer or refund can be requested.

3.2 You are not allowed to activate this service for yourself or others through any of the following methods:

(1) To open this service for oneself or others for non personal use such as profit or business purposes;

(2) Open this service for oneself or others through any robot software, spider software, crawler software, screen swiping software, or other programs or software methods;

(3) Open this service for oneself or others through any improper means or in a manner that violates the principle of good faith and credibility;

(4) Activate this service for oneself or others through methods other than those specified by Twitao;

(5) To open this service for oneself or others by infringing on the legitimate rights and interests of Twitao or others;

(6) Open this service for oneself or others through other means that violate relevant laws, administrative regulations, national policies, public order and good customs.

3.3 The term of this service is subject to the period displayed after you have selected and successfully opened it. You can also log in to Twitao's Image Recognition Member Center to inquire about the specific service terms. The maximum period for opening this service will be subject to certain restrictions, and the specific information will be subject to the announcement on the relevant service page. Before the expiration of the paid membership service, the company may provide you with a renewal reminder. If you fail to renew your paid membership service on time before it expires, the company will stop providing you with paid membership services.

3.4 You understand, acknowledge, and agree that during the service period of this service, any non intentional actions by the company, including Twitao troubleshooting, server maintenance, adjustment, upgrading, third-party infringement handling, etc., may affect your normal use. You agree that Twitao shall be exempt from liability for any adverse consequences arising from the above situations and do not require any additional compensation from Twitao.

3.5 After becoming a paid member of Zhitu, if you apply to cancel or terminate the paid membership service without the fault of Twitao Company, you will not have the right to request Twitao Company to refund the membership service fees you have paid. After the cancellation/termination of your membership in the paid membership program, you are no longer eligible to participate in the paid membership privilege activities and enjoy the various paid membership privileges and value-added services provided by Twitao Company.

3.6 Both parties agree that if any of the following situations occur, Twitao Company has the right to interrupt or terminate one or more services provided to you at any time without notice, and terminate your paid membership, based on the actual situation:

(1) According to laws, regulations, and policies, you are required to submit truthful information, but the personal information you provide is not true, or does not match the information at the time of registration and fails to provide reasonable proof;

(2) You have violated relevant laws, regulations, policies, or the provisions of this agreement and relevant rules and regulations;

(3) According to legal provisions or requirements from regulatory authorities;

(4) For safety reasons or other necessary circumstances.

3.7 If you obtain paid membership services through illegal or improper means, or use channels other than those designated by Twitao, or maliciously refund fees by exploiting vulnerabilities in different channels, Twitao Company has the right to immediately terminate your paid membership services without providing any compensation or refund of opening fees. Non official channels include but are not limited to e-commerce platform proxy charging, private proxy charging, or other unauthorized channels. Any losses caused by your use of unofficial channels shall be resolved by you and the unofficial channels, and Twitao Company shall not be responsible.

4、 Limitation of Liability

4.1 You acknowledge and agree that the content uploaded, published, or transmitted by the user on the Twitao platform is the user's personal act, and Twitao has the right to review and delete it. However, Twitao is not responsible for the accuracy, authenticity, availability, security, completeness, and legitimacy of such information and content. You hereby agree to waive Twitao's relevant responsibilities.

4.2 Within the scope permitted by law, Twitao shall not be liable for service interruption or loss of account, account property, etc. caused by the following circumstances, including but not limited to:

(1) Damage caused by computer viruses, Trojans, or other malicious programs, hacker attacks;

(2) Communication line failures, network or computer failures, and system instability in telecommunications and network communication departments;

(3) Your improper operation behavior;

(4) You have opened/used paid membership services through non Twitao authorized means;

(5) Other situations that are not Twitao's fault and cannot be controlled or reasonably foreseen.

4.3 If you come into contact with illegal, irregular, uncomfortable, or even fearful or disgusted content, please contact Twitao in a timely manner for handling. Thank you very much for your assistance.

4.4 When using, viewing, sharing, reposting, forwarding, and paraphrasing relevant information and content ("usage behavior"), you should make independent judgments and use it legally. Twitao shall not be liable for any self damage or damage to third parties caused by your usage behavior.

4.5 Twitao has the right to handle illegal and irregular content in accordance with the provisions of this agreement. This right does not constitute Twitao's obligation or commitment, and Twitao cannot guarantee timely detection of illegal behavior or corresponding handling. Under no circumstances should you trust loans, request passwords, or other network information related to property.

5、Change and Termination of Agreement

5.1 The suspension or termination of this service includes the following situations:

(1) The user voluntarily terminates or terminates, including but not limited to failure to renew upon expiration;

(2) Twitao voluntarily suspends or terminates its services due to user breach of contract;

(3) Twitao suspends or terminates its services due to national or relevant department requirements or force majeure events;

(4) Other services that should be suspended or terminated according to laws and regulations.

5.2 Due to the special nature of internet services, legal and compliance requirements, or changes in authorization, Twitao has the right to modify, modify, suspend, or terminate some or all of the services (hereinafter collectively referred to as "change behavior"). You agree and understand that the services provided in accordance with any provisions of this agreement may be changed, interrupted, or terminated by Twitao upon prior notice or announcement, and Twitao shall not be liable to you or any third party. However, Twitao will endeavor to minimize the impact of such changes on you. After the change of behavior occurs, if you find that you are unable to log in or enjoy the service, you can consult our customer service personnel.

5.3 Handling after suspension or termination

(1) Except for legal responsibilities, Twitao shall not be liable to users or any third parties for the suspension or termination of this service;

(2) Unless otherwise specified in this agreement, fees already collected shall not be refunded;

(3) Retain relevant member data information for a certain period of time, and other member benefits will be changed or reduced according to website regulations;

(4) For ongoing platform transactions, Twitao will make a reasonable judgment based on the situation, whether to continue or terminate the relevant transactions, and decide whether to refund or deduct relevant fees as liquidated damages depending on the situation.

6、Other agreements

6.1 [Notice]

(1) Under this agreement, all notifications from Twitao to the user can be made through webpage announcements, special pages, on-site messages, client push notifications, customer reserved emails, mobile SMS, or regular mail transmission. Such notifications shall be deemed delivered to the user on the date of sending.

(2) To facilitate your collection of relevant notifications, you should ensure that the reserved contact information is correct and valid, and promptly log in to your Twitao account to make changes. If you fail to provide the correct contact information or inform you of the new contact information in a timely manner, resulting in the inability to receive notifications in a timely manner, you will be responsible for any losses and legal consequences arising therefrom.

(3) Twitao can deliver various notices to you through one or more of the above methods, and the content of such notices may have significant beneficial or adverse effects on you. Please ensure that your contact information is valid and pay attention to it in a timely manner.

6.2 This agreement is signed in Yuexiu District, Guangzhou City, Guangdong Province, People's Republic of China.

6.3 The establishment, effectiveness, performance, interpretation, and dispute resolution of this agreement shall be governed by the laws of the mainland region of the People's Republic of China (excluding conflict of laws).

6.4 If there is any dispute or controversy between you and Twitao Company, it should be resolved through friendly negotiation first; If negotiation fails, you agree to submit the dispute or controversy to the people's court with jurisdiction in the place where this agreement is signed.

6.5 If you wish to activate the automatic renewal function of the paid membership service, you need to read and agree to the Automatic Renewal Service Agreement in addition. The automatic renewal service agreement is a supplementary agreement to this agreement. Your acceptance of the supplementary agreement and specific business rules shall be deemed as your complete acceptance of this agreement.

6.6 Regardless of the reasons for partial invalidity or unenforceability of the terms of this agreement, the remaining terms shall remain valid and binding on both parties.

The titles of all clauses in this agreement are for reading convenience only and have no actual meaning, and cannot be used as a basis for interpreting the meaning of this agreement.
